By booking or participating in any activity offered by Scuba Shack Global LLC ("Scuba Shack," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.
2. Booking and Payment
All bookings are subject to availability. Full payment is required at the time of booking unless otherwise stated. Prices are listed in US dollars and are subject to change without notice. All applicable taxes and fees will be included in the final price at checkout.
3. Cancellations and Refunds
Please refer to our Refund Policy for details on cancellations and refunds.
4. Participant Requirements
Participants must meet all age, health, and certification requirements for their chosen activity. All participants are required to complete a liability waiver before participating in any water activity. Scuba Shack reserves the right to refuse service to anyone who does not meet safety requirements.
5. Assumption of Risk
Water activities including scuba diving, snorkeling, boat charters, and whale watching involve inherent risks. By participating, you acknowledge and accept these risks. Scuba Shack carries appropriate insurance and follows all industry safety standards, but cannot eliminate all risks associated with ocean activities.
6. Weather and Conditions
All activities are weather-dependent. Scuba Shack reserves the right to cancel, reschedule, or modify any activity due to unsafe weather or ocean conditions. In the event of a weather cancellation by Scuba Shack, a full refund or rescheduling will be offered.
7. Liability
Scuba Shack Global LLC, its employees, and agents shall not be held liable for any loss, damage, injury, or death arising from participation in our activities, except where caused by our proven negligence. Our total liability shall not exceed the amount paid for the specific service in question.
8. Photography and Media
Scuba Shack may take photographs or video during activities for promotional purposes. By participating, you consent to the use of your likeness in marketing materials. If you do not wish to be photographed, please notify your guide before the activity begins.
